Rape Scandal: Baba Ijesha set for release due to the ongoing strike by the Judicial Staff Union in Nigeria, so courts are unable to have sessions.
It has been revealed that the Nollywood actor, Olanrewaju Omiyinka aka Baba Ijesha will be released from police custody due to the ongoing strike by members of the Judicial Staff Union of Nigeria, which has made it impossible for the courts to sit.
Based on reports, a senior police officer in Lagos State revealed that they have been instructed to release the actor within the next 24 hours as the suspect could not be detained indefinitely without trial in court.
According to the source: “There was no case of defilement, people are just talking out of sentiment. They are not talking from the point of law. We interviewed all parties involved in the case for three hours today (Wednesday, 28th, April 2021).
However, the mother complained that her child was just seven years old when she was defiled and the child pointed at Baba Ijesha. But the case was not reported until she was 14 years and under the law, the case has become not legally enforceable due to the delay in time.
Based on this new case, the CCTV footage has been assessed, and nowhere was it captured that Baba Ijesha defiled her. The footage mainly showed the actor touching the young girls’ body but it never showed him having any sexual intercourse with the girl.
The young girl also confirmed the same thing. In the law, it is regarded as a case of indecent assault and not sexual harassment, so it is open to bail. The source also made it clear that there is no need for the suspect to be kept in custody based on these assumptions and when there is no court available to have a sitting.
For him to be arrested would be against the actor’s fundamental human rights and the police do not work based on sentiments.
